What will the Settlement Services Affiliate do for me?

  • They will perform the title search and examination that will provide the basis for the title insurance policies issued to you and your lender.
  • They will serve as the liaison to all parties, including your mortgage lender, real estate agent, municipal authorities, tax collectors and everyone else who may be involved in your important purchase.
  • They will provide escrow services and prepare the Settlement Statement of your actual closing cost. They receive deposits and distribute payments so that you can be sure all financial matters are handled by a bonded and experienced company.
  • A Settlement Officer will conduct the closing, which usually takes less than an hour. There, the Sellers will sign the deed and other papers necessary to convey title. The Buyers will sign their mortgage papers and other necessary documents and will pay their closing costs and the balance of any down payment due.
  • The title insurance premium is paid at closing. This one-time fee will provide protection to you for as long as you or your heirs own the property.
  • After settlement, they will record your new deed in the Courthouse, disburse all funds and relevant documentation to the proper parties and issue your new Title Insurance Policy.

What is Title Insurance?

Title insurance is an insurance policy that protects your legal rights to own, possess, use, control and dispose of real estate. It is issued only after a complete and thorough title search is performed. A title search is a comprehensive search of the public records. However, substantial defects may not be discovered. Examples of historical "hidden defects" include:

  • Mistakes in recording of legal documents
  • Forged deeds or other settlement documents
  • Undisclosed or missing heirs, including spouses
  • Deeds executed by persons of unsound mind or executed with an invalid or expired power of attorney
  • Liens for unpaid taxes

An Owner's Policy of Title Insurance is a contract that protects you against the loss or damage due to title defects. For a one-time premium paid at settlement, title insurance protects you against future losses arising out of events that may have happened in the past. As a leading provider of title insurance and settlement services, our settlement services affiliate also offers an Enhanced Owner's Policy of Title Insurance that provides more coverage to you as a homeowner at very little additional cost. This policy offers additional protection not found in the standard Owner's Policy and expands your coverage by providing more protection into the future. Your coverage automatically increases as the value of your home increases and includes, to name a few, building permit violations, subdivision coverage, violation of restrictions on your land, encroachment coverage and post-policy forgery protection.
